This Privacy Policy applies to personal information collected by Guava Lane from you, your external bookkeeper, your legal or financial advisors, other accountants, or related institutions such as banks.
Guava Lane is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
For the purposes of this Privacy Policy, “personal information” has the meaning given in the Privacy Act 1988 (Cth) and includes information or an opinion about an identified individual, or an individual who is reasonably identifiable.
We may update this Privacy Policy from time to time. Any changes will be published on our website so you are always aware of the information we collect, how it is used, and when it may be disclosed.
Please note that if Guava Lane is required by law to disclose information about you or your organisation, we must comply with those requirements.
This Privacy Policy does not apply to acts or practices directly related to employee records of current or former Guava Lane employees.
What Information We Collect and Hold
Guava Lane collects personal information, and in some circumstances sensitive information, that is necessary for or directly related to our functions and activities. These activities include taxation services, business and consulting services, management accounting and bookkeeping, corporate services, audit support, financial planning and related professional services.

What Happens If You Do Not Provide Information

We generally collect personal information directly from you or your authorised representatives. In some cases, we may collect personal information about an associate of a client (such as a spouse or child) where it would be unreasonable or impracticable to collect the information directly from that individual.

Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF)
Guava Lane is subject to obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and associated rules.
As part of these obligations, we are required to verify the identity of our clients and, in some cases, related individuals or beneficial owners. This may involve collecting personal information and conducting electronic or online identity verification, including video-based verification methods.
Where identity verification is conducted electronically or via third-party verification providers, Guava Lane does not retain copies of physical identification documents unless required by law. Verification information is used solely for the purpose of meeting our regulatory obligations.
Guava Lane may also be required to disclose certain information to the Australian Transaction Reports and Analysis Centre (AUSTRAC), including in relation to defined events, suspicious matters or other reportable circumstances. These disclosures are required by law and may occur without prior notice to, or consent from, affected individuals.
Nothing in this Privacy Policy limits Guava Lane’s ability to comply with its obligations under AML/CTF legislation or any other applicable law.
Direct Marketing
With your consent, or where permitted by law, we may use your personal information (such as your name and contact details) to provide information about our services, facilities and benefits, or those of our trusted partners, contractors or suppliers.
Direct marketing communications may include newsletters, service updates, operational notices (such as changes to staffing, rates or services), and business or tax-related insights. Communications may be sent via email, post, SMS, telephone or other permitted channels.

Guava Lane does not sell, rent, trade or otherwise supply personal information to third parties.
We may disclose personal information to third parties only where necessary to provide the services you have engaged us to perform, where you have provided consent, or where required or authorised by law, including under AML/CTF legislation.
We may engage third-party contractors or service providers to support our operations, including contractors located outside Australia. By engaging Guava Lane’s services, you expressly consent to the disclosure of your personal information to these providers for the purpose of delivering our services.
Our current contracting partners include:
IT&C Managed IT Services (Australia) – IT support
SuperRecords (India) – accounting resourcing
Other contractors as notified to you from time to time
All contractors are contractually required to comply with the Privacy Act and the Australian Privacy Principles. Any personal information accessible to contractors is stored on secure servers located in Australia.
We may also disclose personal information to government agencies such as the Australian Taxation Office or Australian Securities & Investments Commission where required by law or in order to provide the services you have engaged us to provide.
Overseas Disclosure
Where personal information is disclosed to contractors located outside Australia, Guava Lane takes reasonable steps to ensure that appropriate safeguards are in place to protect the confidentiality and security of that information. Our contractors must be ISO certified.
Data Breaches
In the event of a data breach that is likely to result in serious harm, Guava Lane will comply with its obligations under the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner where required.

Guava Lane takes reasonable steps to protect personal information from misuse, loss, unauthorised access, modification or disclosure.

Only authorised Guava Lane personnel and approved contractors are permitted to access personal information, and all such individuals are required to maintain confidentiality.
Accessing and Correcting Your Information
You may request access to, or correction of, the personal information Guava Lane holds about you by contacting our Privacy Officer.
There is no charge for making a request. However, we may charge reasonable costs associated with providing access (such as copying or collation) where a request requires significant time or resources. Any anticipated costs will be discussed with you in advance.
We aim to acknowledge access or correction requests within 7 days and respond within a reasonable timeframe, generally within 30 days. We will take reasonable steps to ensure the information we hold is accurate, up to date and complete.
Complaints
